The European Union is once again proving that the road to tyranny is paved with good intentions. A new proposal to criminalise "hate speech" across the bloc is being sold as a necessary tool to fight intolerance and extremism. In reality, it represents one of the most serious attacks on freedom of expression in the democratic world in decades.
As Eugene Volokh and others have pointed out in the Journal of Free Speech Law, this is not just bad policy. It is a fundamental misunderstanding of how free societies actually reduce hatred and protect minorities.
The ProposalThe EU wants to harmonise criminal laws across member states to punish speech that incites hatred or violence based on protected characteristics (race, religion, sexual orientation, etc.). Penalties would be severe, and the definition of "hate speech" would be broad enough to chill legitimate debate, criticism of religion, political opinions, and even humour.
Why This Approach Fails1. It Violates Core Principles of Free Expression. Freedom of speech is not a luxury. It is the foundation of democratic self-government. The European Court of Human Rights and classical liberal tradition have long recognised that even offensive speech must be protected unless it constitutes direct incitement to imminent violence. The EU proposal goes far beyond that, effectively allowing governments to criminalise ideas they dislike.
2. It Won't Reduce Intolerance: It Will Increase It. History shows that suppressing speech does not eliminate prejudice. It drives it underground, creates martyrs, and breeds resentment. Real reductions in intolerance come through open debate, education, cultural change, and the marketplace of ideas, not through state coercion and criminal punishment.
3. The Slippery Slope is Already Here. Europe already has extensive hate speech laws, and we've seen how they are weaponised. Critics of mass migration, Islam, or progressive orthodoxy are routinely investigated or prosecuted. Comedians, journalists, and ordinary citizens have been punished for "wrongthink." Expanding these powers will only accelerate the trend toward iron-fist totalitarianism.
4. A Cure Worse Than the Disease. The greatest threats to social cohesion in Europe today come not from too much speech, but from failed policies on immigration, integration, and elite denial of reality. Criminalising criticism of those policies does not solve the underlying problems: it prevents societies from honestly confronting them.
True tolerance is not enforced silence. It is the confidence that good arguments can defeat bad ones in open debate. Free societies have historically thrived by protecting even repulsive speech, confident that truth and reason would prevail.
The EU's proposal reflects a deep lack of faith in its own citizens and in the strength of liberal democracy. It is the response of elites who would rather punish dissent than defend their ideas.
Europe does not need more speech codes. It needs more speech: vigorous, uncomfortable, and free. The alternative is not harmony. It is resentment, underground radicalisation, and the slow death of democratic legitimacy.
The cure being proposed really is worse than the disease.
