Here is a proposal for a right to bear arms for Australia, via constitutional amendment, and also for America to. There is little chance of something like this getting up in our hyper-liberal woke feminist society, but it is still an interesting thought experiment see if one can draft a piece of legislation that escapes the usual attacks, like the right is just for a militia. So here is my suggested drafting;
"The right of every competent adult citizen to acquire, manufacture, possess, own, carry, use, transport, transfer, inherit, import, export, maintain, repair, modify, and employ arms, shall not be infringed.
For the purposes of this Constitution, "arms" means every weapon, defensive device, munition, ammunition, military implement, vehicle, vessel, aircraft, explosive, projectile system, energy weapon, or other instrument capable of being used for defence, combat, deterrence, or resistance, whether now existing or later developed by science or technology.
This right is recognised as an absolute, pre-political, natural right of self-defence and collective defence, existing independently of government and not created, limited, or withdrawn by any legislature, executive, or court.
No law, regulation, executive order, judicial decision, administrative practice, taxation, licensing requirement, registration scheme, permit system, insurance requirement, waiting period, inspection requirement, storage mandate, zoning restriction, import restriction, export restriction, record-keeping requirement, reporting obligation, fee, surcharge, condition, delay, or any other direct or indirect burden shall diminish, impair, postpone, discourage, or condition the exercise of this right.
No court shall construe this Article narrowly, imply limitations not expressly stated herein, balance this right against competing public interests, or create exceptions by implication. Every ambiguity shall be resolved in favour of the fullest possible exercise of this right.
Any governmental act inconsistent with this Article shall be void ab initio and of no legal force or effect."
