What is it like living in that place once called Victoria? Well, you have to get to like surveillance, not being shy when the police move by your house with their mobile snoop units. They are not interested in your toilet activities but just want to know that you are locked down and passive. Of course, they are not locked down, but sacrifices have to be made.

“Melburnians have expressed outrage at mobile surveillance units that are being covertly deployed to monitor them during the city's Stage Four lockdown. One of the mobile CCTV trailers has been seen in Victoria Gardens in Prahran since last week, as well as other spots in the local government area of Stonnington, in the city's inner-south. 'If you have a look around, everyone is doing the right thing and there's absolutely no need for us to be spied on. They have no regard for our civil liberties,' David Grayson from St Kilda East told The Age after visiting the park on Sunday. Mr Grayson also questioned whether the cameras would have any real impact on helping to enforce restrictions. Are you telling me that someone is watching a screen somewhere and then sends the cops over when they see someone having a picnic or holding hands?' Other residents have also voiced concerns over the mobile surveillance cameras and whether police and local government were overstepping their authority. Denzil Griffiths from Prahran made a complaint to his federal MP Dr Katie Allen who represents the seat of Higgins. 'This is just the latest intrusion in our lives and there's no justification for this type of surveillance. This is a public park, where parents go with there kids, people walk dogs and old people go for exercise as they're all entitled to do', Mr Griffiths said. Victoria Police have confirmed the units are deployed in other areas in Melbourne but would not reveal how many units there are or their locations.” 

     Many people, like me, are too scared now to even go outside their door, even to get the email, so letters, such as the power bill, now spew out onto the footpath, no doubt to soon bring in litter fines, by letters that will not be read either. Anyway, has anyone seriously asked what the limits of the state laws actually are? Could, hypothetically, police be authorised to do anything, not contrary to the federal constitution? Could we get to the situation like the Philippines under Duterte, in the extreme case?

     Extreme, but what prevents this, if not now, then in the future, if we had a new Black Death, or a hypothetical zombie apocalypse virus? I would like to see a constitutionist offer some such explanation, since as I read it, there is nothing to prevent the states exercising all powers not covered in our enabling document, which is very thin by way of human rights. I know that sounds crazy now, but what we have today could not have been predicted in 2019, so it is reasonable to ask the question. I think it raises profound issues about the nature of law, which can only be fully understood by extreme thought experiments. A. V. Dicey, in An Introduction to the Study of the Law of the Constitution (1885), famously held that parliament can make any valid law, including one for the execution of all blue-eyed babies, the doctrine of parliamentary sovereignty, so Duterte is not completely lacking in jurisprudential antecedents.

“Victorians are being fined by police for activities they are allowed to do under public health orders, including going to the supermarket and exercising, while others have been fined for not being at home because they were in hotel quarantine, community legal services say. A lawyer with Inner Melbourne Community Legal, Lloyd Murphy, is concerned increased powers given to police to issue fines during the Covid-19 pandemic are being used inappropriately – and that people are struggling to contest fines due to language barriers or fear. The premier, Daniel Andrews, said in July that one in four people who had tested positive for Covid-19 were not at home when door-knocked by authorities, that 100 cases had been referred to Victoria police, and that it was “unacceptable” that people with Covid-19 were not home. But Murphy said just 42 fines had been issued to people for not staying at home while infected with or being a close contact of someone with coronavirus. Of the 42 people who had been fined, several had approached Inner Melbourne Community Legal for assistance, Murphy said. “We have found that some of them were in fact in hotel quarantine and that’s why they were not at their family residence,” he said. “We also have stories of people in the locked-down community housing towers arranging their own hotel accommodation to better isolate from and protect their families, and then police send infringement notices to their homes. In other cases, the Department of Health and Human Services put them in hotels for the safety of the other tower residents, yet police fined them when they were not home.”

Murphy said the service was yet to successfully dispute any of the fines, despite earlier assurances by police that common sense and “discretion” would be used when reviewing them. Murphy said the legal service was also assisting international students with poor English who were stopped by police while exercising, or while on their way to the supermarket, but who were unable to explain themselves due to a language barrier. He said most were reluctant to allow the legal service to help them dispute the fine through the courts because they were worried it might jeopardise their visa. Other cases being examined by the centre include people stopped by police for jaywalking, but who later received a fine in the mail for breaching Covid-19 restrictions. “The government and police have done an amazing job at highlighting a daily reel of ‘idiots’ who got a Covid fine in the previous 24 hours, and as a result it has helped influence public opinion and the mainstream media to support these police powers and to justify them,” Murphy said. “But they’re not highlighting the hundreds of others who got a fine for not being able to communicate with police, or who were wrongly fined when they were allowed outside.”

Concerns have also been raised by the Independent Broad-based Anti-corruption Commission (Ibac) deputy commissioner, Katie Miller, that Covid-19 may increase the risk of police misconduct. “The breadth of the Covid-19 restrictions and the speed at which they were introduced, along with subsequent changes, understandably creates some uncertainty about how they are applied to any given activity or circumstance,” Miller wrote in her latest newsletter. “The public health emergency presented by Covid-19 may increase the risk of rationalising misconduct on the basis that ‘the ends justifies the means’.” One woman who lives in Fitzroy North told Guardian Australia she was left distressed after two police officers approached her and noted down her details after she took her 11-month-old to Edinburgh Gardens to crawl on the grass. She still does not know if she will receive a fine in the mail as police did not tell her if she was breaking the law. “We had a combative five to 10-minute interaction where one of the officers was unclear whether or not this was within regulations and said he needed to investigate,” she said. “He insisted on taking my details and repeatedly said he needed them because ‘the baby could crawl at home in the lounge room’ and ‘the exercise regulation is for things like running which you can’t do at home’. I repeatedly asked if I was doing something to break regulations because, if so, I would stop, but he said that he wasn’t clear and so would investigate to find out. Two other people saw the whole thing and stopped to ask if I was OK.”

A Victoria police spokeswoman said police were “not in a position” to detail whether the woman was in breach of public health directions. The department of health said if a young child cannot be left at home they can accompany an exercising parent. Ariel Couchman is the chief executive of Youthlaw, Victoria’s free legal service for people under 25, which is currently helping 21 young people with Covid fines. These included a 16-year-old refugee living in Australia with his extended family who was walking with a friend when approached by a stranger asking for directions. Police fined the teenager and his friend $1,652 each for breaking the two-person exercise rule while they were giving directions. Youthlaw is also assisting a young man with mental health issues, including schizophrenia, whose finances are managed by state trustees. He was fined for being outside riding a bike. Meanwhile, a young woman with a developmental delay was fined for shopping more than 5km from her home, despite it being her nearest shopping centre. Police did not attempt to find out why she was there, Couchman said. In another case, three young women experiencing homelessness and being accommodated in a two-bedroom serviced apartment were fined. While two of them were asleep, the third woman invited people over to the apartment. All three received fines, despite the fact that two of them were asleep and did not know about other people being invited over. “Many people have been issued fines when they are not breaching public health directions,” Couchman said. “The police aren’t making proper enquiries to determine why the person is not complying.”

She said in other instances young people had breached the rules due to circumstances beyond their control. “Young people are vulnerable to being targeted by police for Covid breaches, and even more so if they are facing other challenges such as homelessness or a family violence,” Couchman said. “The young people we are helping very much want to comply with the directions and stay safe.” In late June Youthlaw wrote to Victoria’s police commissioner, Shane Patton, asking him to release detailed information about fines issued to date, including the ages and locations of children and what their circumstances were. The legal service wanted police to review and scrap fines issued to children under 18 years where the circumstances failed a common-sense test. Despite following a formal avenue to dispute fines, neither Youthlaw nor a coalition of community legal centres they are working with have successfully applied for a client to have their fine removed. A Victoria police spokeswoman told Guardian Australia that “anyone who receives a penalty notice may request a review by Fines Victoria”.  “Police officers are trained to understand the importance of interacting sensitively and respectfully with communities from all backgrounds, including with vulnerable community groups who have complex needs,” she said. “Effective and appropriate engagement is a priority for police during every interaction with a community member. This applies both during this emergency management response phase and to policing in general.” But Daniel Nguyen, the advocacy coordinator with the Police Accountability Project, run by Flemington and Kensington Community Legal Centre, said his centre had not successfully appealed fines for any clients. “We are unaware of anyone who has successfully challenged an infringement,” Nguyen said. “We have also had clients with mental health issues who had infringements issued against them we believe are uncalled for. We feared at the beginning of the pandemic that when it came to police enforcement of health directives that it would disproportionately impact those from diverse, Indigenous and public housing communities, and those with mental health issues, and that is what we are seeing. Nguyen said while the centre’s data was anecdotal, “we have been unable to get detailed data including about where people are being fined, their age, and other details.”

     If Australians had any love of freedom, a movement should begin to wide constitutional change, giving people basic protections such a freedom of speech and association. But, in this divided society that is too much to hope for. Back in 1901 the urge to get commerce flowing was too great to spend the time to get out a constitution that could have prepared us for the world we now face, but that is I suppose too much to have asked, few people of that time would have believed that we could be in the state we are presently. They could not even protect the nation from future mass immigration, least India be offended. It was all over before it begun. Still, we are where we are, and getting together a new political party aimed at defending freedoms may be a starter; Free Australia Party?
