Political Tribes: Group Instinct and the Fate of nations By Peter West

     Political commentator Amy Chua has been concerned with issues of the nation and nationalism for some time. In her latest book Political Tribes: Group Instinct and the Fate of Nations, (Penguin Press, 2018 released on February 20, making this one of the first negative reviews in Australia), she deals with the issue of the nation and the re-emergence of tribalism.

     Chua is one writer who is unafraid of following the argument where evidence requires it to go, and she cites studies from across the physical and social sciences which indicate that tribalism is hardwired into human biology. We thus have in-group loyalties and out-group antipathies, much as we see with football teams, which is a microcosm of the big societal picture.

State Tribunals and Judicial Power By Ian Wilson LL.B

     Parliaments, both state and federal have the power to confer judicial power on various tribunals. Today the vast number of tribunals that litter the judicial landscape do much of the heavy lifting in administrative and related fields of law: immigration review matters, guardianship law, consumer dispute issues, Centrelink review matters, and much more. Often tribunals have a flexibility that courts lack, with a review of the merits of the case, hearing it from the start, rather than just reviewing an issue of law. The Administrative Appeals Tribunal is a case, in reviewing Centrelink and other administrative matters.

     State parliaments can confer, or give, judicial power to State tribunals, but such tribunals cannot exercise Federal jurisdiction, that is, decide on “Federal; matters, because that would be contrary to the Constitution. However, there are areas where matters get tricky, such as seen in the case of Burns v Corbet; Gaynor v Burns [2017] NSWCA 3 (3 February 2017), where there is a dispute between residencts of two states, arising under state law determined by a State tribunal, the tribunal exercising judicial power, but  not being a Chapter III Court, as defined by the constitution. Is there an implied limitation on the legislative power of the State relative to sections 75 and 76 of the Constitution on such tribunals which are not Chapter III Courts? Is a State law which confers judicial power on such tribunals inconsistent with section 39 of the Judiciary Act 1903?

To THE AGE          Some of us see the government’s response to the Uluru Statement from the Heart very differently to the way in which Waleed Aly views it (‘Such a sorry way to behave’, 16/2). We are sceptical that the advisory body that issued it (which was formed by invitation only) was really adequately representative. Secondly, we believe that the ‘formal apology a decade ago’ was also unrepresentative and in fact a piece of gesture politics having no mandate from the Australian people as a whole.

     Thirdly, it is disappointing to learn that the prime minister has announced a new inquiry into constitutional recognition. Public discussion in the last two decades has more than adequately established that any such recognition is against the interests of national unity and fundamentally inequitable. That is why no referendum proposal favouring it will succeed. Finally, ‘Indigenous perspectives’ are already being widely heard and acted upon at all levels of government anyway.
